Metro Trailer Sales (A Division of Metro Centre Ltd.) hereinafter referred to as manufacturer warrants each new trailer to be free from defects in material and workmanship under normal use and service for a period of one year from date of original sale. The original or copy of the original Invoice must be provided by the customer when a claim is made.

Warranty Covers

Manufacturer makes no warranty with respects to tires, wheels, brake system, axle assemblies, hitches, paint, lights, decking, or other accessories not manufactured by the manufacturer, as these items are usually warranted specially by the respective Manufacturers of these items. (Normal wear will not be replaced, due to wear).

Limitations

Manufacturers liability and obligation is limited to repair or replacement of the product provided the purchaser returns the claimed defective product to the manufacturer, or authorized distributor, with transportation charges prepaid, and examination by manufacturer discloses the product is defective.

Warranty Void

This warranty does not cover said product, which has been repaired or altered outside of the factory of the manufacturer in any way so as to in the judgment of the manufacturer affect the stability, reliability, or performance of the product. This warranty does not cover damage or product failure caused by accident, misuse, negligence, tampering, overloading, improper attachment or improper maintenance. Loading in excess of gross vehicle load ratings stated on the certificate plate will invalidate any and all warranties. This warranty excludes any and all liability for consequential or incidental damages.

Transportation Costs Excluded

Transportation of any trailer to and from your dealer or an approved repair facility shall be the responsibility of the trailer owner. Metro Trailer Sales shall not be held responsible for any such cost.

Disclaimers

This warranty is expressly in lieu of all other warranties and representation, expressed or implied, and all other obligations or liabilities on the part of the manufacturer. No one, including an authorized Metro Trailer Sales dealer is authorized to make further or additional warranties on behalf of Metro Trailer Sales.

Warranty Acceptance

Upon the purchase of a Metro Trailer Sales trailer, the purchaser agrees to the manufacturer's Limited Warranty, which is accompanied with the purchase of the trailer. The purchaser agrees that he/she has been informed of the limited warranty & claim procedures and will perform all responsibilities under this Limited Warranty.

Within five (5) Days after discovering a problem with your Metro Trailer Sales trailer, return the trailer for inspection to the Metro Trailer Sales Dealer where you bought the trailer. If your dealer cannot repair the problem free of charge and you want to file a claim under this Warranty, you local dealer must send to Metro Centre Ltd. a letter either faxed or mailed with all the required information, within (10) days of your discovery of the defect. Metro Centre Ltd. will acknowledge such receipt of claim by fax or mail to the dealer and to the claimant and will respond as soon as possible, but no later than thirty (30) days after receipt of the claim. Any defective part(s) must be sent by prepaid freight to Metro Centre Ltd. In order to qualify the claimant for the replacement or reimbursement under this limited warranty. Any defective parts must be returned to Metro Centre Ltd. Within 30 days from date of approval to qualify for reimbursement. Metro Centre Ltd. will not reimburse any claimant for any adjustment or repair of a Metro Trailer Sales trailer without written approval by Metro Centre Ltd. Metro Centre Ltd. reserves the right to not pay unreasonable cost for replacement or repair of defects in Metro Trailer Sales trailers and may, at it discretion, establish reasonable reimbursement for any authorized work performed under the terms of this Limited Warranty. When required, photos of defective part(s) or the actual part(s) may have to accompany the warranty approval before payment can or will be made. Metro Centre Ltd. HERE MAKES NO OTHER EXPRESS OR IMPLIED WARRANTIES AND THERE ARE NO OTHER WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE OF THIS LIMITED WARRANTY.

WARNING

DO NOT MODIFY METRO TRAILER SALES PRODUCTS. INSTALL ONLY ON SPECIFIED VEHICLES IN GOOD CONDITION. METRO TRAILER SALES TOWING PRODUCTS ARE DESIGNED TO TOW TRAILERS. USE ONLY FOR THIS PURPOSE. Do not attach cargo carriers, motorcycle carriers, boat hoists, or coupler alignment devices. Do not extend the original structure. Do not use to pull or push the towing vehicle. Do not use as a jacking point. Do not attach anything with or in place of the ball. DO NOT TOW MULTIPLE TRAILERS. Towing one trailer behind another may cause severe instability and loss of control. FAILURE TO HEED WARNINGS AND FOLLOW INSTRUCTIONS MAY RESULT IN VEHICLE CRASH, PROPERTY DAMAGE AND PERSONAL INJURY.                       DON'T OVERLOAD ANY PART OF YOUR TOWING SYSTEM

Proper and Regular Trailer Maintenance

Proper and Regular maintenance of your trailer will help insure longer use. To help you with you maintenance, we suggest the following: Use correct ball size for trailer hitch Lug nuts should be torqued regularly Proper tire pressure should be maintained at all times Wheel bearing should be checked at least once a year Check all electrical connections regularly Check upon each hook up that all lights are operational Brakes should be checked and adjusted at least once a year Maintain proper fluid levels Load on trailer should be evenly distributed. Your trailer should be inspected and serviced regularly for optimal life of trailer

DEXTER AXLE LIMITED WARRANTY

WHAT PRODUCTS ARE COVERED Dexter Axle's spring suspension type axles ("Spring Suspension Axles") and Torflex Axle Suspension's ("Torflex Axles"). LIMITED WARRANTY FOR SPRING SUSPENSION AXLES Dexter Axle warrants to the original purchaser that the Spring Suspension Axles will be free from defects in material and workmanship for a period of one (1) year from the date of purchase by the original purchaser. LIMITED WARRANTY FOR TORFLEX AXLES Dexter Axle warrants to the original purchaser that the Torflex Axles, exclusive of hubs, drums, brakes, bearings and seals, will be free from defects in material and workmanship for a period of five (5) years from the date of purchase by the original purchaser. Dexter Axle warrants to the original purchaser that the hubs, drums, brakes, bearings and seals that are part of the Torflex Axles will be free from defects in material and workmanship for a period of one (1) year from the date of purchase by the original purchaser. EXCLUSIVE REMEDY Dexter Axle will, at its option, repair or replace (without installation) the affected components of any defective Spring Suspension Axle or Torflex Axle, repair or replace (without installation) the entire defective Spring Suspension Axle or Torflex Axle, or refund the then current list price of the Spring Suspension Axle or Torflex Axle. In all cases, a reasonable time period must be allowed for warranty repairs to be completed. WHAT YOU MUST DO In order to make a claim under these warranties: 1. You must be the original purchaser of the recreational vehicle in which the Spring Suspension Axles or Torftex Axles were originally installed. 2. You must promptly notify us within the warranty period of any defect and provide us with any substantiation that we may reasonably request. 3. The Spring Suspension Axles and Torflex Axles must have been installed and maintained in accordance with good industry practice and any specific Dexter Axle recommendations, including those specified in Dexter Axle's publication "Operation, Maintenance Service Manual." EXCLUSIONS These warranties do not extend to or do not cover defects caused by: 1. The connecting of brake wiring to the trailer wiring or trailing wiring to the towing vehicle wiring. 2. The attachment of the running gear to the frame. 3. Hub imbalance, or any damage caused thereby. 4. Parts not supplied by Dexter Axle. 5. Any damage whatever caused by or related to any alteration of the axle. 6. Use of a Spring Suspension Axle or Torflex Axle on a unit other than the unit to which it was originally mounted. 7. Normal wear and tear. 8. Alignment. 9. Improper installation. 10. Damage (not resulting from defects in material or workmanship) while in the possession of the original purchaser. 11. Unreasonable use (including failure to provide reasonable and necessary maintenance as specified in Dexter Axle's publication "Operation, Maintenance Service Manual" including required maintenance after "Prolonged Storage"). 12. Improper wheel torque. 13. Welding supplemental brackets/members onto the existing Torflex Suspension beam. LIMITATIONS 1. In all cases, Dexter Axle reserves the right to fully satisfy its obligations under the Limited Warranties by refunding the then-current list price of the defective Spring Suspension Axle or Torflex Axle (or, if the axle has been discontinued, of the most nearly comparable current product). 2. Dexter Axle reserves the right to furnish a substitute or replacement component or product in the event a Spring Suspension Axle or Torflex Axle or any component of these axles is discontinued or is otherwise unavailable. 3. These warranties are non-transferable. GENERAL THE FOREGOING WARRANTIES ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES EXCEPT THAT OF TITLE, WHETHER WRITTEN, ORAL OR IMPLIED, IN FACT OR IN LAW (INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE). These warranties give you specific legal rights, and you may also have other rights which vary from state to state. THE DURATION OF ANY IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THE EXPRESS WARRANTIES HEREIN. DEXTER AXLE HEREBY EXCLUDES INCIDENTAL AND CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF TIME, INCONVENIENCE, LOSS OF USE, TOWING FEES, HOTEL BILLS, TELEPHONE CALLS OR COSTS OF MEALS, FOR ANY BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, APPLICABLE TO THE SPRING SUSPENSION AXLES AND TORFLEX AXLES. Some states do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so the above exclusion or limitation may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from state to state. The remedies of the original purchaser set forth herein are exclusive and the liability of Dexter Axle with respect to the Spring Suspension Axles and Torflex Axles, whether in contract, tort, warranty, strict liability or other legal theory shall not exceed the then-current average list price charged by Dexter Axle to its customer for the affected Spring Suspension Axle or Torflex Axle at the time that the claim is made.
